Overview of Child Neglect in California

In California, one form of child neglect is prosecuted under Penal Code § 270. If a parent willfully fails to provide a child under 18 with necessities such as food, clothing, shelter, medical care, or other qualifying remedial care, without a lawful excuse, the parent can be charged under this statute.

“Willfully” means the failure must be deliberate. A genuine inability to provide necessities can constitute a lawful excuse if the parent has made reasonable efforts and lacks sufficient income or assets through no fault of their own.

California law also makes clear that a parent is not automatically relieved of the duty to provide necessities because the parents are divorced, were never married, or because the child is in the custody of the other parent or another person.

Child Endangerment Under Penal Code § 273a

Not every California child neglect case is charged under Penal Code § 270. Penal Code § 273a also prohibits certain conduct that causes or permits a child to suffer unjustifiable physical pain or mental suffering, injury, or dangerous conditions.

If the circumstances are likely to produce great bodily harm or death, the offense can be charged as a felony carrying two, four, or six years in state prison. The child abuse or neglect charge and potential penalties depend on the specific conduct alleged.

Our San Diego child neglect attorneys can review your charges and explain how California law applies.

What Are the Penalties for Child Neglect in San Diego, California?

A standard violation of Penal Code § 270 is generally a misdemeanor. A conviction can carry up to one year in county jail, a fine of up to $2,000, or both.

The penalties can be more serious in a case involving a prior final adjudication of parentage. If a person has notice of that adjudication and later willfully fails, without lawful excuse, to provide necessities for the child, Penal Code § 270 can authorize up to one year in county jail or a term of one year and one day in state prison.

The criminal penalties are only one part of what’s at stake. A child neglect allegation can also trigger CPS involvement with dependency proceedings that are separate from the criminal case and follow different rules and standards of proof. A juvenile court can address child safety, custody, visitation, and services independently of the criminal prosecution.

Because the proceedings can affect one another, our San Diego criminal defense lawyers know to account for any parallel dependency case from the start.

What Defenses Can Be Raised If I’m Arrested for Child Neglect?

Because Penal Code § 270 requires a willful failure without lawful excuse, the defense often depends on the parent’s ability to provide, the circumstances surrounding the alleged failure, and whether the prosecution can prove each required element.

The statute also provides that proof of abandonment, desertion, or failure to provide necessities can create prima facie evidence that the omission was willful and without lawful excuse. That makes the facts surrounding the alleged failure especially important.

Potential defenses include:

These cases are highly dependent on their facts, and the strongest defense will depend on the evidence. An attorney from our firm can review the allegations and determine which issues may be challenged.
