California Rape Law Under Penal Code 261

California Penal Code 261 defines rape as nonconsensual sexual intercourse accomplished through force, violence, threats, fraud, or in situations where the victim was unable to give consent.

The statute was most recently amended by SB 258, which took effect on January 1, 2026. Now, the law covers all forms of rape, including acts that were previously prosecuted under the former spousal rape statute (PC 262).
